BKP offers its clients the option of communicating via electronic data transfer. If the client desires to receive communication via electronic data transfer from BKP, the following shall be agreed: 1.1 If information is transmitted electronically, transmission errors cannot be excluded. Neither the sender of a message, personally, nor BKP shall be liable for any damage resulting from transmission errors, except in cases of gross negligence. 1.2 BKP does not assume any responsibility for any change of or modification to transmitted documents that have not been expressly approved by us. 1.3 If an e-mail or a fax message or any of the attached documents should contain information unrelated to BKP's work, no responsibility shall be assumed for that information. 1.4 No liability shall be accepted for any e-mails from co-workers that have not been confirmed in writing. Receipt of e-mails may be disrupted for technical or operational reasons. Therefore, the following shall be agreed: Time-sensitive or significant messages must be sent to BKP by surface mail, courier, or telefax. Sending e-mails to BKP shall neither constitute compliance with time limits nor have triggering effect. Clients communicating with BKP via e-mail acknowledge that messages sent via the internet may be received by persons other than the addressees. If a client desires data sets sent by BKP to be encrypted, a specific agreement shall be concluded in a particular case. E-mails sent by BKP will include a disclaimer that may read, for example, as follows: Terms and conditions for communication via electronic data transfer (e-mail, fax)
